Employee Notice: Employees must provide at least 30 days’ notice before the start of the leave if the need for the leave is foreseeable. If the leave is not foreseeable, the employee must provide notice as soon as possible.

Employer Notice: Employers must inform employees of their eligibility for FMLA leave within five business days of the employee’s request for leave or the employer’s knowledge that leave may be for a FMLA-qualifying reason.

Designation Notice: Employers must inform employees within five business days of their designation of leave as FMLA-protected and the amount of leave counted against the employee’s FMLA leave entitlement.

Helpful FMLA Definitions

The Family and Medical Leave Act (FMLA) is a federal law that requires certain employers to provide eligible employees with up to 12 weeks of unpaid, job-protected leave per year for specified family and medical reasons.

An eligible employee is an employee who has worked for the employer for at least 12 months, has at least 1,250 hours of service in the past 12 months, and works at a location where the company employs at least 50 employees within 75 miles

Family and medical reasons include the birth and care of a child, placement of a child for adoption or foster care, care for a spouse, parent, or parent-in-law with a serious health condition, or the employee’s own serious health condition that makes them unable to perform the essential functions of their job.

A serious health condition is an illness, injury, impairment, or physical or mental condition that involves inpatient care or continuing treatment by a health care provider.
